Kigra Creative con domicilio Villa Encinos, Campo 10, Colonia Manitoba, Cuauhtémoc, Chih. México, en adelante denominado “KIGRA” Fotografía y Diseño Gráfico profesional a través de la web www.kigracreative.com ( la “web”).
La transacción realizada a través de la Web será facturada por KIGRA, con la que se entiende celebrado el contrato. Los presentes Términos y Condiciones son, por lo que la expresión KIGRA es denominativa de cualquiera de ellas.

La utilización de la Web y la contratación de los servicios (los “Servicios”) que en ella se ofertan, supone por parte de sus usuarios y/o clientes (en adelante, ambos denominados indistintamente “Usuario” o “Usuarios”) la aceptación de las Condiciones Generales de Contratación, Condiciones Específicas definidas en el proceso de compra y de las Normas de Privacidad que se actualizan periódicamente, por lo que es importante que el Usuario las lea cada vez que visite la Web, así como todas aquellas condiciones específicas de cada Servicio o venta de cualquier producto de índole gráfica, las cuales también deberán ser aceptadas.

Por la simple navegación en la Web, no existe entre KIGRA y el Usuario ningún acuerdo. KIGRA ofrece a través de la Web información relacionada con los Servicios y Productos que comercializa a través de ella.
Accediendo y utilizando la Web, el Usuario se obliga a aceptar las condiciones generales que a continuación se exponen (las “Condiciones”):

KIGRA se reserva el derecho de cambiar, modificar, añadir o eliminar en cualquier momento parte de las Condiciones y a hacer cambios en los Servicios sin previo aviso.

Todos los medios y requerimientos técnicos que se precisen para acceder a la Web y a los Servicios serán por cuenta exclusiva del Usuario, así como cualesquiera gastos o impuestos a los que la prestación de los Servicios o adquisición de los Productos pueda dar lugar.

EXCLUSIÓN DE RESPONSABILIDAD

KIGRA no se responsabiliza de los daños o perjuicios derivados del acceso, uso o mala utilización de los contenidos de la Web. El uso de la Web se realiza bajo la cuenta y riesgo del Usuario. Ni KIGRA, ni sus representantes o agentes serán responsables de cualquier pérdida o perjuicio, o daños, ni directos ni indirectos, ni especiales ni causales, de cualquier forma conectados con o que resulten del uso de la Web o de cualquier información en ella contenida. Mediante la aceptación de las Condiciones, el Usuario renuncia expresamente a cualquier reclamación contra KIGRA que provenga del uso de la Web o de la información en ella contenida.

RESPONSABILIDAD POR CONTENIDOS
KIGRA no se responsabiliza de las posibles discrepancias que puedan surgir entre la versión de sus documentos impresos y la versión electrónica de los mismos publicados en la Web. Los documentos, diseños y fotografías publicados en la Web, podrían incluir inconsistencias técnicas o errores tipográficos. La información está sometida a cambios periódicos pudiendo KIGRA hacer en cualquier momento mejoras o cambios en los Servicios aquí descritos.
KIGRA no responde de la veracidad de las informaciones que no sean de elaboración propia, ni asume responsabilidad alguna en cuanto a perjuicios que pudieran originarse por el uso de dicha información.
PROPIEDAD INDUSTRIAL E INTELECTUAL
Esta página contiene y hace referencia a derechos de propiedad industrial o intelectual de KIGRA. Todo el contenido de esta página, como texto, gráficos, logos, iconos, imágenes, recopilaciones de datos, así como software es exclusiva propiedad de KIGRA y todo ello protegido por las leyes de Copyright internacional.
KIGRA se reserva el uso de acciones judiciales civiles y/o criminales contra aquellas personas físicas o jurídicas y sus representantes que violen lo dispuesto en las Condiciones, especial en lo que concierne a derechos de Copyright.
La web no está destinada a distribución, uso o acceso de personas de jurisdicciones en las cuales el hecho de entrar a esta página conllevase a KIGRA infringir cualquier ley o normativa en esa jurisdicción.
MAYORÍA DE EDAD Y CAPACIDAD LEGAL
El Usuario declara que es mayor de edad (mayor de 18 años o de 21 en algunas jurisdicciones) y goza de la capacidad legal necesaria para contratar los Servicios ofertados en la Web de conformidad con las Condiciones, que comprende y entiende en su totalidad. En caso de contratación por parte de un menor de edad KIGRA no será en ningún caso responsable, debiendo asumir el propio menor, sus padres o tutores los gastos y consecuencias que ello pudiera ocasionar. El acceso a la Web es responsabilidad exclusiva de los Usuarios.
ACEPTACIÓN DE CONDICIONES
Una vez que el Usuario hubiera accedido a la Web, para proceder a la contratación de los Servicios deberá seguir todas las indicaciones e instrucciones recogidas en el procedimiento de compra, cumplimentando a estos efectos las Condiciones Particulares y demás formularios fijados para cada Servicio, lo cual supondrá la lectura y aceptación de todas las Condiciones Generales y Particulares de aplicación.
Mediante el check in de aceptación de Condiciones el Usuario ratifica la contratación con KIGRA, confirmando fechas indicadas en el proyecto, día de la sesión/junta, locación elegida, gastos en viáticos, y cualquier otra Condición Particular del Servicio que se detalle en la cotización o acuerdo con el cliente. El Usuario se compromete a confirmar la veracidad y exactitud de la información aportada, siendo nula aquella contratación en la que el usuario haya aportado información falsa. No se aceptará en ningún caso documentos de confirmación de contratación resultado de información falsa.

Las Condiciones y precio de la reserva contratados, son los que se determinan expresamente en el procedimiento de compra, reservándose KIGRA, el derecho de modificar los precios previa notificación al Usuario.
Una vez realizada la contratación KIGRA remitirá al Usuario por e-mail los comprobantes y/o documentos de aplicación al proyecto específico.
Las presentes Condiciones, las condiciones específicas de venta de la tarifa reservada por el Usuario y la confirmación o solicitud de reserva, expresan la integralidad de las obligaciones entre las partes.
Ninguna condición general o específica comunicada por el Usuario se podrá integrar a las presentes Condiciones.
Los documentos que componen los compromisos contractuales entre las partes son, por orden de prioridad decreciente, el bono o la solicitud de proyecto (incluidas las condiciones particulares de la tarifa reservada) y las presentes Condiciones.
En caso de contradicción entre el anticipo de proyecto y las Condiciones, lo dispuesto en la cotización será lo único aplicable para la obligación que se cuestione.

TARIFAS Y FACTURACIÓN
En la tarifa desglosada se mostrará el precio final del Servicio contratado, impuestos indirectos o cualquier otra tasa o impuesto que sea de aplicación en el país de prestación del Servicio.
Algunos países solicitan para entrar y/o salir de su territorio, tasas que se han de pagar por el Usuario en calidad de turista o visitante, y que han de ser recaudados por KIGRA, quien posteriormente ha de remitirse al Gobierno de dicho país. KIGRA, realizará sus mejores esfuerzos para que el Usuario esté informado de dicha tasa de manera previa a la contratación.
KIGRA, no enviará a los Usuarios en ningún caso facturación, confirmación u otros documentos relacionados con la reserva en formato papel. El Usuario acepta el compromiso de KIGRA, con el medioambiente, y por ello acepta la modalidad electrónica de recepción de documentos.
Los precios relativos a la reserva de los Servicios se indican antes y durante la reserva.
Los precios se expresan por servicio o producto y fotos adquiridas.
Los precios se confirman al Usuario con todos los impuestos incluidos, en la divisa compra venta del tipo de cambio del banco a la fecha de compra en establecimiento (por lo que en determinados casos puede ser diferente de la divisa local del Usuario) y son válidos sólo para el periodo indicado en la página Web.
La conversión de divisas se indica sólo a título informativo, nunca contractual. Sólo está garantizada la moneda que se haya confirmado en el momento de la reserva (si dicha moneda es diferente de la de KIGRA, los posibles costes del cambio de moneda correrán a cargo del Usuario).
MEDIOS DE PAGO
El Usuario deberá hacer efectivo el pago mediante cualquiera de las modalidades ofrecidas.
En función de la anticipación de pago del proyecto, las formas de pago ofrecidas podrán ser las siguientes:Pago fraccionado o depósitos: En el momento de efectuar el anticipo se abonará el tanto por ciento indicado en el detalle de la cotización y antes de la fecha indicada en el mismo detalle se abonará el porcentaje restante del precio. Todo ello en el bien entendido que si no se realiza el segundo pago en el plazo indicado, será tratado como si de una cancelación se tratara. En caso de cancelación por parte del Usuario, KIGRA se deslinda de cualquier responsabilidad de entrega de materiales gráficos o fotografías realizadas hasta la fecha de la cancelación.

Pago en Efectivo: Los pagos en efectivo deberán realizarse en la divisa de México. Con tal de cumplir con la legislación vigente en materia de limitación de pagos en efectivo.
Pago Paypal: El pago de paypal deberán realizarse a la divisa de México, queda a discreción del usuario realizar pago puesto que es un servidor de pago independiente, KIGRA se reserva el derecho aclaración en esta opción.

RESERVAS, CANCELACIONES Y ATENCIÓN AL CLIENTE
El Usuario podrá modificar o cancelar el proyecto a través de la Web o email. Las condiciones de modificación o cancelación del proyecto serán las que figuren en el proceso de compra especificado en la Web y que el Usuario conoce y acepta expresamente al momento de realizar el proyecto.
El contacto con KIGRA para solicitar información, realizar sugerencias o llevar a cabo una reclamación, se realizará vía telefónica al 52 614 182 3470 o a través del formulario que se activa al acceder al enlace de “Contacto” situado en el menú principal de la Web.

SESIÓN FOTOGRÁFICA
Antes de la llegada a la locación, el medio de confirmación de la reserva será siempre el comprobante de anticipo.
El Usuario se compromete mandar comprobante del anticipo antes de realizar la sesión con el Fotógrafo, aceptando que si dicho documento no se presentase, no podrá garantizarse las condiciones de la reserva.
SESIONES EN LOCACIONES
El Usuario acepta y se compromete a comportarse siempre de forma adecuada. Todo comportamiento contrario a las buenas costumbres y al orden público podrá permitir a KIGRA a Cancelar la sesión y solicitar al Usuario abandonar la locación sin indemnización alguna o sin ningún tipo de reembolso si ya se ha realizado un cargo.
VALIDEZ DE OFERTAS
Las ofertas de la Web sólo serán válidas durante el tiempo que permanezcan accesibles a los Usuarios para su contratación efectiva mediante el proceso de compra establecido.
La cotización mostrada por la Web está basada en la tarifa vigente para el país de residencia del Usuario, tomando como referencia su dirección IP. En caso de que por discrepancia entre la IP de acceso del Usuario y su país de origen se produzca un error , KIGRA se reserva el derecho de modificar la cotización del sistema avisando previamente al Usuario.
PRINCIPIO DE CONSERVACIÓN
Si una o varias de las cláusulas incluidas en las Condiciones fuese declarada total o parcialmente nula o ineficaz, esta declaración afectará sólo a dicha disposición o a aquella parte que haya sido así declarada, subsistiendo las Condiciones en todo lo demás, teniéndose tal disposición o la parte de la misma afectada, por no puesta.
NOTIFICACIONES

Todas las notificaciones, requerimientos, peticiones y otras comunicaciones que hayan de efectuarse por las partes en relación con las Condiciones, deberán realizarse por escrito y se entenderá que han sido debidamente realizadas cuando hayan sido entregadas en mano o bien remitidas por correo ordinario al domicilio de la otra parte o al correo electrónico de ésta.(14).

Derecho de Autor y Propiedad de los Materiales:
(A) la fotografía se incluye una foto, imágenes, transparencia, negativa, exploración digital, comercial, diseño, flyer, obra de arte, pintura, dibujo de montaje, propaganda, banner , grabado o cualquier otro artículo que pueda ofrecerse con fines de reproducción; (B) la reproducción incluye cualquier forma de publicación o copia de la totalidad o parte de una fotografía o diseño y si está o no alterada por la impresión, la fotografía, la proyección de diapositivas (sea o no una audiencia) xerografía, referencia del artista, ilustración del artista, presentación o presentación , Reproducción o almacenamiento electrónico o mecánico por cualquier otro medio; (D) el Cliente es la persona u organización a la que se dirige la factura (ya sea que el Cliente actúe o no por un tercero); (C) el Fotógrafo / Diseñador (también conocido como KIGRA ) es el Autor de la fotografía o el diseño.
(D) KIGRA, suministra la capacidad técnica y artística para ilustrar una idea fotográficamente y en cualquier proyecto de diseño gráfico, y se reserva el derecho a reproducir esas imágenes en un contexto dado. Ninguna propiedad o derechos de autor sobre ninguna imagen pasará al Cliente ya sea en su presentación o en la concesión de KIGRA, de derechos de reproducción con respecto a la misma; (E) KIGRA afirma tanto su derecho moral a ser identificado como autor de su obra como el derecho a un crédito se afirma (B) El título de todas las fotografías sigue siendo propiedad de KIGRA (F) Estos términos y condiciones representan la totalidad del acuerdo entre KIGRA y el Cliente. (A) Todo el copyright de las imágenes es retenido por, KIGRA en todo momento en todo el mundo y es administrado por el mismo; (F) A menos que se acuerde otra cosa por escrito si cualquier fotografía reproducida por el Cliente omite el aviso de derechos de autor o línea de crédito especificada por KIGRA , cualquier tarifa pagadera por el Cliente estará sujeta a un aumento especificado por KIGRA y en cualquier caso un aumento de No menos del 25%.(16). Uso y reproducción: (A) La Licencia de Uso sólo entrará en vigor una vez que se haya efectuado el pago completo de la factura. No se puede hacer uso de las imágenes hasta que se haya recibido el pago completo y final - incluyendo cualquier cargo por pago atrasado que se haya recaudado - por KIGRA; (B) El permiso por escrito puede ser concedido para el uso de la imagen antes del pago, sin embargo este permiso será revocado inmediatamente si el pago de la factura no se hace por la escala de tiempo indicada en la factura; (C) Las imágenes serán autorizadas para su uso y reproducción del cliente con Licencia de Uso si es requerida, limitada durante el tiempo de 15 días de su existencia. Cuando la Licencia de Uso ha expirado, las imágenes procederán a ser eliminadas. KIGRA se reserva el derecho de informar al cliente por escrito y o cualquier otro medio, que todos los archivos digitales han sido destruidos. Se notifica al cliente garantía de Licencia de Uso cuenta con un plazo de 15 días a partir de la fecha de emisión de la Licencia de Uso. KIGRA se reserva el derecho de hacer uso y o reproducción de sus imágenes con fines que convengan sin consentimiento previo .(C) Los derechos de reproducción (si y cuando se conceden) se limitan estrictamente al uso y al período de el cliente quien en la factura . Un acuerdo debe ser alcanzado con KIGRA antes de que las imágenes se utilicen con un propósito diferente o después de que la licencia para usar haya expirado; (D) Los derechos de reproducción no se otorgan exclusivamente al Cliente excepto cuando se especifique en la factura o pago; (E) Los derechos de reproducción otorgados son personales para el Cliente y no pueden ser cedidos, ni puede ser prestado o transferido a terceros, salvo para el propósito del ejercicio de tales derechos de reproducción; (F) Cualquier derecho de reproducción otorgado es por medio de licencia y no se implicará ninguna cesión parcial o alguna de derechos de autor; (G) KIGRA se reserva el derecho de negarse a suministrar o conceder una licencia de reproducción a un tercero cuando así lo solicite el Cliente; (17).

JURISDICCIÓN Y LEY APLICABLE Cualquier conflicto que proceda del uso de la Web, Deberá procesarse en lugar de residencia que se regirá por Ley Estados Unidos Mexicanos y los Juzgados de Chihuahua, México.

4. INDUSTRIAL AND INTELLECTUAL PROPERTY

This page contains and refers to industrial or intellectual property rights of KIGRA. All content on this page, such as text, graphics, logos, icons, images, data compilations, as well as software is the exclusive property of KIGRA and all of it is protected by international copyright laws.

KIGRA reserves the use of civil and/or criminal legal actions against those individuals or legal entities and their representatives who violate the provisions of the Conditions, especially with regard to Copyright rights.

The website is not intended for distribution, use or access by persons from jurisdictions in which the fact of entering this page would lead KIGRA to violate any law or regulation in that jurisdiction.

5. AGE OF MAJORITY AND LEGAL CAPACITY

Contract confirmation documents resulting from false information will not be accepted in any case.

The Conditions and price of the contracted reservation are those that are expressly determined in the purchase procedure, reserving KIGRA, the right to modify the prices prior notification to the User.
Once the contract has been made, KIGRA will send the User the receipts and/or application documents for the specific project by e-mail.
These Conditions, the specific conditions of sale of the rate reserved by the User and the reservation confirmation or request, express the entirety of the obligations between the parties.
No general or specific condition communicated by the User can be integrated into these Conditions.
The documents that make up the contractual commitments between the parties are, in descending order of priority, the voucher or the project request (including the particular conditions of the reserved rate) and these Conditions.
In case of contradiction between the project advance and the Conditions, the provisions of the quote will be the only applicable for the obligation in question.

7. RATES AND BILLING

The itemized rate will show the final price of the contracted Service, indirect taxes or any other rate or tax that is applicable in the country where the Service is provided.

Some countries request to enter and/or leave their territory, fees that must be paid by the User as a tourist or visitor, and that must be collected by KIGRA, who must subsequently remit it to the Government of said country. KIGRA will make its best efforts so that the User is informed of said rate prior to contracting.

KIGRA will not send Users in any case billing, confirmation or other documents related to the reservation in paper format. The User accepts KIGRA's commitment to the environment, and therefore accepts the electronic method of receiving documents.

The prices related to the reservation of the Services are indicated before and during the reservation.

Prices are expressed per service or product and photos purchased.

The prices are confirmed to the User with all taxes included, in the purchase currency of the bank's exchange rate on the date of purchase in the establishment (so in certain cases it may be different from the User's local currency) and are valid only for the period indicated on the website.

The currency conversion is indicated for information only, never contractual. Only the currency that has been confirmed at the time of booking is guaranteed (if said currency is different from KIGRA's, the possible costs of changing the currency will be borne by the User).

8. PAYMENT METHODS

The User must make the payment through any of the methods offered.

Depending on the advance payment of the project, the forms of payment offered may be the following:

Installment payment or deposits: At the time of making the advance, the percentage indicated in the detail of the price will be paid and before the date indicated in the same detail, the remaining percentage of the price will be paid. All this on the understanding that if the second payment is not made within the indicated period, it will be treated as if it were a cancellation. In case of cancellation by the User, KIGRA disclaims any responsibility for the delivery of graphic materials or photographs taken up to the date of cancellation.

Cash Payment: Cash payments must be made in the currency of Mexico. In order to comply with current legislation regarding the limitation of cash payments.

Paypal payment: Paypal payment must be made in the currency of Mexico, it is at the discretion of the user to make payment since it is an independent payment server, KIGRA reserves the right to clarify this option.

9. RESERVATIONS, CANCELLATIONS AND CUSTOMER SERVICE

The User may modify or cancel the project through the Web or email. The conditions of modification or cancellation of the project will be those that appear in the purchase process specified on the Web and that the User knows and expressly accepts at the time of carrying out the project.

10. PHOTO SESSION

Before arrival at the location, the means of confirming the reservation will always be the advance payment receipt.

The User undertakes to send proof of the advance payment before carrying out the session with the Photographer, accepting that if said document is not presented, the conditions of the reservation cannot be guaranteed.

SESSIONS ON LOCATIONS

The User accepts and undertakes to always behave appropriately. Any behavior contrary to good customs and public order may allow KIGRA to Cancel the session and request the User to leave the location without any compensation or without any type of reimbursement if a charge has already been made.

11. VALIDITY OF OFFERS

The offers on the Website will only be valid for as long as they remain accessible to Users for their effective contracting through the established purchase process.

The price shown on the Website is based on the current rate for the User's country of residence, taking their IP address as a reference. In the event that an error occurs due to a discrepancy between the User's access IP and their country of origin, KIGRA reserves the right to modify the system's price, notifying the User in advance.

12. CONSERVATION PRINCIPLE

If one or more of the clauses included in the Conditions were declared totally or partially null or ineffective, this declaration will affect only said provision or that part that has been so declared, subsisting the Conditions in everything else, having such provision or part of the same affected, for not laying.

13. NOTIFICATIONS

All notifications, requests, petitions and other communications that must be made by the parties in relation to the Conditions must be made in writing and it will be understood that they have been duly made when they have been delivered by hand or sent by ordinary mail to the address of the other party or to the latter's email.

(A) photography includes a photo, images, transparency, negative, digital scan, commercial, design, flyer, artwork, painting, montage drawing, advertisement, banner, print, or any other item that may be offered for the purpose of reproduction; (B) reproduction includes any form of publication or copying of all or part of a photograph or design and whether or not altered by printing, photography, slide show (whether or not an audience), xerography, artist reference artist, artist's illustration, presentation or presentation , Reproduction or electronic or mechanical storage by any other means; (D) Customer is the person or organization to whom the invoice is addressed (whether or not Customer is acting for a third party); (C) the Photographer / Designer (also known as KIGRA ) is the Author of the photograph or design.

(D) KIGRA, provides the technical and artistic capacity to illustrate an idea photographically and in any graphic design project, and reserves the right to reproduce these images in a given context. No ownership or copyright in any image shall pass to Client either in its submission or in KIGRA's grant of reproduction rights with respect thereto; (E) KIGRA asserts both your moral right to be identified as the author of your work and the right to credit is asserted (B) Title to all photographs remains the property of KIGRA (F) These terms and conditions represent the entire agreement between KIGRA and the Client. (A) All copyright in the images is held by, and administered by, KIGRA at all times throughout the world; (F) Unless otherwise agreed in writing if any photograph reproduced by Customer omits the copyright notice or line of credit specified by KIGRA, any fees payable by Customer will be subject to an increase specified by KIGRA and in in any case an increase of not less than 25%.(16). Use and reproduction: (A) The Use License will only come into force once the full payment of the invoice has been made. No use of the images may be made until full and final payment - including any late fees that may have been collected - has been received by KIGRA; (B) Written permission may be granted for the use of the image prior to payment, however this permission will be revoked immediately if payment of the invoice is not made by the time scale indicated on the invoice; (C) The images will be authorized for use and reproduction by the client with a Use License if required, limited to the time of 15 days of its existence. When the Use License has expired, the images will proceed to be deleted. KIGRA reserves the right to inform the client in writing and or by any other means, that all digital files have been destroyed. The client is notified of the License of Use guarantee, which has a term of 15 days from the date of issue of the License of Use. KIGRA reserves the right to use and/or reproduce its images for purposes that are convenient without prior consent. (C) Reproduction rights (if and when granted) are strictly limited to the use and period of the customer who in the invoice. An agreement must be reached with KIGRA before the images are used for a different purpose or after the license to use them has expired; (D) Reproduction rights are not granted exclusively to Customer except as specified on invoice or payment; (E) The reproduction rights granted are personal to the Client and may not be assigned, nor may it be loaned or transferred to third parties, except for the purpose of exercising such reproduction rights; (F) Any reproduction right granted is by license and no transfer of any or all copyright is implied; (G) KIGRA reserves the right to refuse to supply or grant a reproduction license to a third party upon Customer's request.

JURISDICTION AND APPLICABLE LAW Any conflict arising from the use of the Web must be processed in the place of residence that will be governed by the Law of the United Mexican States and the Courts of Chihuahua, México.
